ARTICLE 6 – SECURE PAYMENT
Payment for the products is made by bank card (Eurocard, Visa, Carte Bleue, Mastercard) or Paypal.
Concerning a payment by bank card, Paypal is alone, through its secured space, to have knowledge of the banking information of the customer. This information does not pass in any way to the website www.peauapeau.shop.
Paypal allows you to pay online without communicating your financial information during the transaction.
Under the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By communicating their credit card number and the above-mentioned information, the customer authorises Peau à Peau to debit their credit card for the total amount including VAT of their order (delivery costs included).
To this end, the customer confirms that they are the holder of the bank card to be debited and that the name appearing on this bank card to be debited is indeed theirs. They then communicate, in a secure environment on the website of our payment partner Paypal, the sixteen-digit number and the expiry date, appearing on the front of their bank card, as well as, if necessary, the numbers of the visual cryptogram appearing on the back of the bank card.
In order to provide additional security to online payment by credit card, this payment will benefit from the 3D secure program.
The purpose of this program is to combat fraud by asking Internet users who wish to make a payment on the Internet to identify themselves at the time of payment by bank card on the website of the online merchant.
During the transaction, the cardholder is directed to a webpage of his bank and enters data that the bank can verify.
This security is evidenced by the presence of the logos “Verified by VISA” or “MasterCard SecureCode”.
ARTICLE 7 – SHIPPING AND DELIVERY
Orders placed on www.peauapeau.shop are prepared in 48 to 72 hours.
When the order is being delivered, the customer receives an e-mail indicating the Post Office, Colissimo or TNT tracking number.
Peau à Peau cannot be held responsible for losses, delays in delivery due to errors or disruptions attributable to the post.
In case of error in the wording of the delivery address by the customer, Studio Romeo will not be held responsible for delays or non-delivery of products ordered. In this case, the costs incurred for the re-shipment of the products will be charged to the customer.
Any order delivered outside France may be subject to taxes and customs duties that will be imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of a product are the responsibility of the customer.
Each delivery is deemed to have been made as soon as the product is made available to the customer by the carrier, materialised by the delivery tracking mentioned on the website of the Post Office.
If, five working days after the shipment of the package, the customer has no news of their order, they must approach the Post Office closest to the place of delivery. If neither the Post Office nor the delivery tracking system offered on the Colissimo websites and mentioned above have no trace of this package, the customer must then contact Peau à Peau through its Customer Relations Department which will then open an inquiry with the Post Office. The Post Office’s final response times vary from one to three weeks from the time the issue is raised.
Considered in particular as cases of force majeure relieving Peau à Peau of its obligation to deliver are war, riot, fire, flood, strikes, accidents, and the impossibility of obtaining supplies etc.
In any event, delivery of our products on time can only take place if our buyers are up to date with their obligations to us.
It is up to the customer to check the shipments on arrival and to make any reserves and complaints which would appear justified, even to refuse the parcel, if this seems likely to have been opened or if it carries visible traces of deterioration. The aforementioned reservations and complaints must be addressed to the carrier by registered letter with acknowledgement of receipt within three working days, not including public holidays, following the delivery of the products, and a copy will be sent immediately to Peau à Peau. Failure to make a claim within these said time limits shall extinguish any action against the carrier in accordance with the provisions of Article L 133-3 of the Commercial Code.
The customer must make sure that the articles which were delivered to them correspond to their order. If the articles delivered do not conform in kind or quality to the specifications indicated in the delivery order, the customer must inform Customer Relations by email: firstname.lastname@example.org and return the articles to the address and under the conditions provided in Article 8.
ARTICLE 8 – RETURN POLICY
In accordance with Articles L 221-18 and following of the Consumer Code, the customer has a cooling-off period of fourteen days from delivery to reconsider their decision and return the item ordered without having to justify their reasons or pay penalties. Within this statutory 14-day period, the delivery costs will then be refunded if the customer returns the order in its entirety. In case the customer returns only a part of the order, the shipping costs will remain at their charge.
The return costs are the responsibility of the customer.
In all cases, items must be returned in their original packaging, complete, labelled, new, unworn, unwashed and accompanied by the delivery note to the following address email@example.com.
Returned items that do not meet the conditions listed above (returned in their original packaging, complete, labelled, new, unworn, unwashed, as above) or that are damaged, spoiled, harmed or soiled by the customer will not be refunded.
The risks involved in return are always the responsibility of the customer. The customer is, therefore, strongly encouraged to return the parcel by any means which offers proof of its sending and giving them a specific date (registered with acknowledgement of receipt, Colissimo tracked, etc.). Otherwise, Peau à Peau will not be able to process your return.
Once the goods have been received, processed and accepted by our services, Peau à Peau will refund the customer the price of the returned products at the latest within fourteen (14) days from receipt of the products.
For any other information, complaint or question relating to the conditions of sale by mail order set up by Peau à Peau, customers should contact the Customer Relations Department by e-mail at the following address: firstname.lastname@example.org, recalling in both cases the reference and the date of the order.
ARTICLE 9 – WARRANTY AND LIABILITY
Notwithstanding the specific warranty conditions given to the customer with the delivered item, the items marketed on the website www.peauapeau.shop are subject to the warranty conditions provided by law.
The responsibility of Peau à Peau cannot be committed:
– in the event of a breach of contractual obligations due to an act of God or force majeure;
– in case of non-substantial differences between the photos, texts and illustrations of the articles on our website and the ordered articles.
ARTICLE 11 – CONFIDENTIALITY OF DATA
Peau à Peau manages an electronic file which lists specific personal data relating to its customers. When any new customer places an order on the www.peauapeau.shop website, this database is enriched with information concerning the customer, which will then allow the customer’s expectations to be better met, and facilitate the services provided by the Peau à Peau Customer Service.
This database has been the subject of a declaration, in accordance with the requirements of the Data Protection Act of 6 January 1978, amended by the Act of 6 August 2004.
In the event that the customer would agree to communicate individual personal data, they would then have the individual right to access, withdrawal and correction provided for by law and could in this regard have information concerning them, that would no longer be relevant, deleted, by making the request in writing to Peau à Peau, at the following address: email@example.com.
ARTICLE 12 – INTELLECTUAL PROPERTY RIGHTS
The “Peau à Peau” brand, illustrations, logos and slogans, designs and models appearing on the website are and will remain the exclusive property of Peau à Peau. Any total or partial reproduction, without Peau à Peau’s express prior consent, is strictly prohibited under Articles L 335-2 and L 335-3 of the Intellectual Property Code and constitutes an infringement and an offence.
ARTICLE 13 – APPLICABLE LAW
The present general conditions of sale and the commercial relationship between Peau à Peau and the customer are governed by French law. Any dispute relating to the business relationship between Peau à Peau and the customer shall be submitted to the jurisdiction of the French courts.
